Who we are

Effect Sense (“we”, “us”, or “our”)  is registered in Finland with a business ID 2808523-7 and is owned and run by Pyry Survo. Our website address is: https://effectsense.com.

What personal data we collect and why we collect it

Checkout
When you place an order at the Checkout page, the following information (“Customer Data”) you provide is collected by us:

• Email address
• First name
• Last name
• Billing address
• IP address
• Company name
• VAT number

The Customer Data is collected for two reasons:

1. To handle and deliver your purchase, customer support, and future free product updates (we need to collect your email address to do so).
2. To comply with Finnish bookkeeping laws and European Union regulations regarding VAT (we need to collect your name, billing address, IP address, company name, and VAT number to do so).

The Customer Data will not be disclosed to third parties. The Customer Data will not be distributed outside the EU or the EEA. The Finnish tax authorities may require us to pass on the data to them for tax reporting purposes.

Some information we collect during checkout is disclosed to PayPal for necessary payment processing. This information includes your email address, first name, last name, and billing address. The information you provide on PayPal website is processed by PayPal. See PayPal Privacy Policy.

Comments
When you leave comments on the site we collect the data shown in the comments form, and also your IP address and browser user agent string to help spam detection.

An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service privacy policy is available here: https://automattic.com/privacy/. After approval of your comment, your profile picture is visible to the public in the context of your comment.

Newsletter mailing list
By registering on the mailing list or for the newsletter, your email address and name will be added to our contact list. We may use the contact list to send you email messages containing information of commercial or promotional nature concerning Effect Sense. Your email address will also be added to this list if you checked the “YES, join the free Effect Sense email newsletter” box during checkout and made a purchase. We do not use our contact list to create custom audiences or retargeting groups on Facebook or any other marketing platform without your clear consent.

Currently, we are using MailChimp (The Rocket Science Group, LLC.) to manage and send our email newsletters. By registering on our mailing list, MailChimp will collect your email address, name, and IP address and processes the data in the United States. See MailChimp Privacy Policy. If we ever switch to another email address management and message sending service, we upload our contact list on their server and start sending our newsletters using their service.

Contact forms
If you submit a contact form at the Contact Us or Multi-user License page, the information and the message you provided will be automatically sent to Effect Sense email inbox on our web hosting server. We will use the contact form submission for customer service purposes. We do not store email addresses or other information sent via contact form submissions on any list. We do not use the information submitted through contact forms for marketing purposes.

Cookies
We are using cookies to give you the best experience on our site. Cookies are files stored in your browser and are used by most websites to help personalise your web experience. We use cookies for two purposes: 1) Web shop functionalities 2) Website traffic analytics.

The essential cookies used by our web shop functionalities include adding products to your shopping cart and completing a purchase. Without these cookies our web shop wouldn’t work. Cookies used to collect website traffic analytics are generated by Google Analytics and are stored by Google on servers in the United States. These statistics help us to analyze how users browse our site. User behaviour data collected by Google Analytics is anonymous and cannot be used to track or identify an individual user.

We use SoundCloud, an audio content delivery service provided by SoundCloud Limited, to incorporate audio previews of our sound effects on our website. YouTube video widget (Google Inc.)
YouTube is a video content visualization service provided by Google Inc. that allows us to incorporate video content on our website. Analytics

Our site uses Google Analytics, a web analytics service provided by Google, Inc. (“Google”). Google Analytics uses “cookies”, which are text files placed on your computer, to help the website analyse how users use the site. The information generated by the cookie about your use of the website will normally be transmitted to and stored by Google on servers in the United States. Google will use this information for the purpose of evaluating your use of the website, compiling reports on website activity and providing other services relating to website activity and internet usage to the website provider. How long we retain your data

The customer data collected at checkout will be stored at Effect Sense servers and bookkeeping records for at least 6 years according to Finnish laws. However, to provide great customer service, we try to store the names and email addresses of our customers on our servers for as long as Effect Sense website is running and selling sound effects. Why? If you ever need to download your sound effects again, we can see your order history and quickly send you the new download links. Also, we can send you an email message if we ever release a free update to the products you purchased. However, if you wish your order history and other information to be deleted from our servers, just contact us and your data will be removed.

If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.

If you subscribe to our newsletter, your name and email address you provide during the subscription process are retained indefinitely. You may subscribe at any time and your data will be removed from our MailChimp mailing list.

Google Analytics retains the anonymous visitor data from our site for 50 months.

Legal basis of processing

We may process personal data relating to you (the “User”) if one of the following applies:

• Users have given their consent for one or more specific purposes. Note: Under some legislations Effect Sense may be allowed to process personal data until the User objects to such processing (“opt-out”), without having to rely on consent or any other of the following legal bases. This, however, does not apply, whenever the processing of personal data is subject to European data protection law;
• provision of data is necessary for the performance of an agreement with the User and/or for any pre-contractual obligations thereof;
• processing is necessary for compliance with a legal obligation to which Effect Sense is subject;

• processing is necessary for the purposes of the legitimate interests pursued by Effect Sense or by a third party.

Place

The data is processed at our operating offices in Finland and in any other places where the parties involved in the processing are located.

What rights you have over your data

If you have made a purchase on this site, have left comments, or have subscribed to our newsletter, you can request to receive an exported file of the personal data we hold about you, including any data you have provided to us. You can also request that we erase any personal data we hold about you. This does not include any data we are obliged to keep for administrative, legal, or security purposes. You have the right to withdraw consent where you have previously given your consent to the processing of your personal data. Also, you have the right to bring a claim before your competent data protection authority.

What data breach procedures we have in place

If a data breach occurs and is noticed by us, we take immediate action and send email messages to inform our customers and newsletter subscribers about it. We may also post a news article about the breach on our blog.

Legal action
Your personal data may be used for legal purposes by us in court or in the stages leading to possible legal action arising from improper use of our sound effects, website, or related services.

You declare to be aware that we may be required to reveal personal data upon request of public authorities.

System logs and maintenance
For operation and maintenance purposes, our web hosting service (Suomen Hostingpalvelu Oy) collects your IP address and usage data to their log. The system log maybe be accessible by the Suomen Hostingpalvelu Oy’s employees if needed for maintenance or security purposes.

Changes to this privacy policy
We reserve the right to make changes to this privacy policy at any time by giving notice to our users on this page and possibly sending a notice to our newsletter subscribers. It is strongly recommended to check this page often, referring to the date of the last modification listed at the top.

Should the changes affect processing activities performed on the basis of your consent, we shall collect new consent from you, where required.

Security

Our site uses Secure Sockets Layer (SSL) technology to protect your information. The checkout page interacts with PayPal Express Checkout, an established PCI-DSS compliant third-party credit card processing vendor via SSL links, to handle the actual private and secure transactions.

We do not store or process credit card or debit card numbers on our servers or systems. We cannot see your credit card or debit card numbers at any point.
